Terms & Conditions

The walking trips and all associated services provided by Captain Co Pty Ltd trading as We Who Wander (“We Who Wander”, “we”, “our”, “us”) are subject to the following Terms & Conditions. These Terms & Conditions apply to all bookings, travellers and participants forming part of a booking.

1. Acceptance of Terms

Your booking becomes valid once We Who Wander has received the required deposit or full payment.

By paying a deposit or making full payment, you acknowledge and agree that:

The person making a group booking warrants that they have authority to act on behalf of all travellers within the booking.

2. Independent Contractors & Third-Party Suppliers

You acknowledge that accommodation, transport, food services, activity providers and other components of your itinerary may be supplied by independent third-party contractors.

While We Who Wander exercises reasonable care in selecting suppliers, we are not liable for:

All accommodation is subject to availability and may be substituted with accommodation of a similar standard where reasonably necessary.

3. Booking & Payment Terms

Deposits

A non-refundable deposit of 50% of the total booking value is required to confirm a reservation unless otherwise stated in writing.

Final Payment

Full payment is required no later than 30 days prior to departure. If full payment is not received by the due date, We Who Wander reserves the right to cancel the booking and apply applicable cancellation fees.

Late Bookings

For bookings made within 30 days of departure, full payment is required at the time of booking.

Currency

All prices are quoted in Australian Dollars (AUD).

Group Bookings

Group bookings are treated as a single booking unless otherwise agreed in writing. We Who Wander is not responsible for redistributing refunds or credits between members of a group.

If the number of participants within a group changes after pricing has been quoted, We Who Wander reserves the right to re-price the itinerary.

4. Pricing & Price Changes

Prices may change prior to a deposit being paid.

Once a deposit has been received, the confirmed itinerary price will not increase except where:

Any quotation is subject to availability until confirmed by payment.

5. Amendments & Rebooking Fees

After confirmation and issue of final itinerary documents, amendments requested by guests may incur administration fees.

Unless otherwise advised:

We Who Wander is not obliged to accept requested itinerary changes.

6. Customer Cancellation Policy

We understand circumstances may change and recommend comprehensive travel insurance.

Cancellation notices must be provided in writing.

Group Bookings

Where one or more participants withdraw from a group booking:

We Who Wander reserves the right to cancel, modify or curtail an itinerary where reasonably necessary due to:

9. Force Majeure

We Who Wander is not liable for delay, cancellation, injury, loss or additional costs arising from events outside our reasonable control, including but not limited to:

10. Travel Insurance

Comprehensive travel insurance is strongly recommended and should include cover for:

International guests are strongly encouraged to obtain medical insurance valid in Australia.

You acknowledge that remote areas may involve delayed access to medical treatment and emergency services.

11. Park Closures, Fire & Flood Events

The Great Ocean Walk and surrounding parks may close without notice due to:

Where a closure occurs after departure has commenced, no refund is available.

Where the Great Ocean Walk or sections of the walk are closed prior to departure and We Who Wander cannot reasonably operate the itinerary, guests may be offered:

12. Fitness, Medical Conditions & Participant Responsibilities

Participants must:

No refund will be given where participation is refused on reasonable safety grounds.

Unless expressly stated otherwise, itineraries are self-guided. Participants are responsible for their own navigation, pacing, personal judgment, hydration, equipment and on-trail decision-making.

Guests are responsible for:

If a participant cannot complete a walking section, they must make reasonable efforts to reach the nearest safe access point where collection can occur.

Collection delays may occur.

13. Assumption of Risk

By participating, you acknowledge that hiking and outdoor adventure activities involve inherent risks including:

You voluntarily assume all inherent risks associated with participation.

Outdoor conditions form part of the intended experience. Weather, visibility, track quality, mud, wind, rain, temperature and environmental conditions may vary significantly and do not constitute grounds for refund, compensation or cancellation outside the terms outlined in this agreement.

Guests are responsible for all costs associated with rescue, evacuation, ambulance transport, medical treatment, retrieval services or emergency response arising from injury, illness or inability to continue the itinerary.

To the maximum extent permitted by law, We Who Wander excludes liability for personal injury, illness, death, property damage or loss arising from participation in activities conducted as part of the itinerary, except where caused by our negligence and where liability cannot legally be excluded.

Warning Under the Australian Consumer Law and Fair Trading Act 2012 (Vic)

Under the Australian Consumer Law and Fair Trading Act 2012 (Vic), several statutory guarantees apply to recreational services. These guarantees may, in certain circumstances, be excluded, restricted or modified.

By participating in activities provided by We Who Wander, you acknowledge that hiking, outdoor adventure activities and associated transport involve significant inherent risks, including the risk of personal injury, illness or death.

To the maximum extent permitted by law, We Who Wander excludes liability for death, personal injury or loss suffered in connection with the supply of recreational services where such liability may lawfully be excluded under applicable legislation.

14. Limitation of Liability

To the fullest extent permitted by law:

Guests are responsible for their own personal belongings at all times. We Who Wander accepts no responsibility for loss, theft or damage to luggage, hiking equipment or personal property, including items transported between accommodations or left at accommodation providers.

Certain rights under the Australian Consumer Law may apply and cannot be excluded.

15. Medical Emergencies

If We Who Wander reasonably believes medical assistance is required, you authorise us to:

16. Dietary Requirements & Catering

We Who Wander will make reasonable efforts to accommodate dietary requirements notified in advance but cannot guarantee allergen-free food preparation.

Meals may contain or come into contact with:

Guests with severe allergies or medical dietary requirements participate at their own risk.

Dietary changes requested within 14 days of departure may not be accommodated.

Guests choosing self-catered options are fully responsible for their own food preparation and storage.

17. Alcohol, Drugs & Smoking

Smoking and vaping are prohibited:

Illegal drug use is strictly prohibited.

We Who Wander reserves the right to remove any participant from all or part of an itinerary without refund where their conduct is unsafe, disruptive, abusive, threatening, intoxicated, illegal, discriminatory, harassing or negatively impacts the safety, wellbeing or experience of staff, suppliers or other guests.

18. Damage & Additional Costs

Guests are liable for:

We Who Wander reserves the right to recover such costs from the booking holder.

18A. Transport & Transfer Timing

Pickup and transfer times are approximate only and may vary due to weather, road conditions, traffic, operational requirements, emergencies or delays outside our reasonable control.

While We Who Wander will make reasonable efforts to operate transfers in accordance with the itinerary, exact timing cannot be guaranteed.

18B. Payment Authority

By making payment, the booking holder warrants they are authorised to use the nominated payment method and authorises We Who Wander to process payments in accordance with the agreed booking terms.

Guests agree not to initiate unjustified payment disputes or chargebacks for services delivered in accordance with these Terms & Conditions.

19. Photography & Marketing

We Who Wander may occasionally use photographs or video captured during trips for promotional purposes.

If you do not wish to appear in promotional material, you must notify us in writing prior to departure.

20. Complaints

If you experience an issue during your trip, you must notify We Who Wander as soon as reasonably possible to allow an opportunity to resolve the matter during the trip.

Complaints submitted after completion of travel may limit our ability to investigate or resolve the issue.

20A. Complaint Resolution & Public Statements

Guests agree to provide We Who Wander with a reasonable opportunity to address complaints or operational concerns directly before publishing materially false, misleading or inaccurate public statements regarding their experience.

21. Privacy

Personal information collected by We Who Wander is used for:

Information may be shared with third-party suppliers where reasonably necessary to operate your itinerary.

22. Governing Law

These Terms & Conditions are governed by the laws of the State of Victoria, Australia.

Any dispute arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Victoria.

23. Severability

If any provision of these Terms & Conditions is found unenforceable, the remaining provisions remain in full force and effect.
